("Terms") apply
to your use of our analog digitization services
offered by
No Rewind ("we," "us," or "our"). By
submitting your
analog media for digitization, you agree to be
bound by
these Terms.
1. Service Description
We convert your analog media into digital files in various formats (e.g., MP4, AVI). We offer various service packages with different turnaround times and storage options. Please refer to our website or pricing guide for detailed information.
2. User Warranties and Indemnification
You warrant that:
You own the copyright to the content on the analog media or have obtained the necessary permissions from the copyright holder for digitization.
The content does not violate any laws or infringe upon the rights of any third party.
The media is free from any defects or damage that might hinder the digitization process.
You agree to indemnify and hold us harmless from any claims, losses, damages, or expenses arising from your breach of these warranties.
3. Data Privacy and Security
We take your privacy seriously. We will
not share,
sell, or otherwise disclose your personal
information or the
content of your analog media to any third party,
except as
required by law or to investigate suspected
illegal
activity.
4. Data Retention and Deletion
Your digitized files will be stored securely for 30 days following completion of the service. After 30 days, your files will be permanently deleted without prior notification.
You are solely responsible for downloading and saving your files within the 30-day period. We recommend backing up your files to a personal storage device.
5. Limitation of Liability
We are not liable for any loss of data,
damage to
your analog media, or any other damages arising
from the use
of our services, except to the extent caused by
our
intentional misconduct or gross negligence.
6. Disclaimer of Warranties
We provide our services "as is" and without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. Governing Law and Dispute Resolution
These Terms shall be governed by and
construed in
accordance with the laws of Prince Edward
Island, Canada,
without regard to its conflict of law
provisions. Any
dispute arising out of or relating to these
Terms shall be
resolved by court in Prince Edward Island,
Canada.
8. Entire Agreement
These Terms constitute the entire agreement between you and us regarding the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
9. Amendment
We reserve the right to modify these
Terms at any
time without prior notice. We will post the
revised Terms on
our website and notify you via email if we make
any material
changes.

By submitting your Analog Media for digitization, you acknowledge that you have read and understood these Terms and agree to be bound by them.
